PROGRAMS

Training
program on Leadership and Conflict
Transformation
Two days training program on Leadership
and Conflict Transformation was organized
on 14-15th January, 2010 at Kathmandu
School of Law with support of an organization
Didibahini. The program aimed to practically
facilitate the participants on Leadership
and Conflict Transformation through
the means of various games and to
formulate action plan to conduct research.
Altogether twenty five participants
from LL.B. participated in the program.
Members of Didibahini Youth Forum
Ms. Nabina Bajracharya, Mr. Kabindra
Regmi and Mr. Raju Shakya facilitated
the session. Mr. Ram Chandra Gautam
and Ms. Kamana Neupane of LL.B. 3rd
Year who had received training on
the South Asian Training Program on
leadership and conflict transformation
also acted as the facilitators.
The program mainly discussed on the
conceptual framework of leadership,
international practices on leadership
and conflict transformation along
with practical demonstration on responsibilities
of the leader in group work, and conflict
transformation process. The two days
discussion helped participants in
learning communication, co-operation
and co-ordination process as the best
measure for conflict transformation.

Residential
School on Law of Intellectual Property
Business Law Centre of KSL organized
three days Residential School on Law
of Intellectual Property from 19-21
February, 2010. The main objective
of the School was to enhance understanding
of participants about the importance
of intellectual property, enrich them
to look into the issue jurisprudentially
and analytically and equip them with
tools and techniques to use the property
for the development of the country.
The program was inaugurated by Hon'ble
Prem Bahadur Singh, Minister of Law
and Justice on 19th February, 2010.
Residential professors Dr. Elizabeth
Varkey, Gandhi University, Kerela;
Asst. Prof. Narayan Sharma and Raj
Kumar Suwal, KSL were also present
in the program. Addressing the inauguration
session, chief guest Singh expressed
that intellectual property is very
important issue to be discussed and
plays significant role in commercial
laws together with human rights issue.
He expressed his belief that the School
will enhance the capacity of the participants
and boost the development of IP sector
in Nepal but the practical application
in this aspect is necessary. Speaking
at the program Dr. Varkey emphasized
on the prospect, impact of intellectual
property in least developed countries.
We do not view it as human rights
issues, she added. Welcoming all the
participants and the guests, Asst.
Prof. Raj Kumar Suwal made a brief
overview of the program.
The program discussed on the thematic
issues on trade mark, patent, industrial
design, geographical indicator and
traditional knowledge. Along with
these discussions Asst. Prof. Narayan
Sharma also added the jurisprudential
perspective on exercise of rights
on intellectual property.
The residential school was conducted
with presentation on different topics
by participant themselves followed
by discussion and comments from expert
commentators. The School was formally
concluded by Professor Incharge Madhav
Pd. Acharya with the distribution
of awards and certificates of participation
based on the presentation and overall
performance as marked by commentators
and residential resource persons.
Altogether 40 participants from LL.M.
and LL.B. participated in the School.

Interaction
Program on Truth and Reasoning
KSL students organized interaction
program on "Truth and Reasoning"
on 26th March 2010 at KSL. The program
was facilitated by Prof. Dr. Yubaraj
Sangroula. Students of LL.B. 2nd Year
and 4th Year participated in the program.
Prof. Dr. Yubaraj Sangroula discussed
on logic, truth and reasoning. He
further said belief is the foundation
to prove truth scientifically. Epistemologically,
our five senses smell, touch, hear,
feeling and sight bear the truth.
It is contextual and differs substantially.
It is subjective and objective. The
prior proved truth is subjective and
empirically proved truth is objective,
he added. Additionally discussing
about theories of truth he said, there
are various theories of truth substantial
theory, rules of inference and so
forth.
The interaction was a part of a weekly
program which is organized by KSL
students every Friday.

Forum Theatre
on Youth Perspective on Federalism
International IDEA in collaboration
with Alliance for peace and DEMO Finland
organized a forum theatre on 'Youth
Perspective on Federalism' on 13th
of April, 2010 at KSL. The purpose
of the program was to aware people
and constituent assembly members on
the role of youth in the national
building process. The objective behind
conducting the drama at KSL was to
collect necessary inputs and suggestions
from law students in regards to Youth
Rights (education, employment, health
etc.) in the context of federalism
from a youth perspective. Feedback
from KSL students in those subject
matters will help the group in preparing
their submission to the Constituent
Assembly.

Interaction
on Juvenile Justice System and its
Practice in Nepal
Forum for Philosophical Discussion
organized an interaction program on
"Juvenile Justice System and
its practice in Nepal" on 30th
April, 2010. Mr. Prabhakar Khanal,
a Child Psychologist as well as member
of the Juvenile Bench of Bhaktapur
District Court appeared as an expert
to present and facilitate discussion
on the above subject. The program
was attended by students of LL.B.
1st, 2nd and 3rd year.
In the program Mr. Khanal mentioned
that Juvenile Justice is considered
as the fair and proper administration
of laws relating to Juveniles or the
laws which will govern the acts and
behaviour of the young who has not
completed 16 years of age. He said
the rate of child delinquency is getting
higher day by day and the laws relating
to juveniles in Nepal are not adequate,
and even most of the courts do not
effectively follow the procedures
as envisaged by the available laws
in the best interest of the child.
He also claimed that Bhaktapur District
Court has been practicing the laws
and procedure relating to juveniles
as envisaged by the laws.

Discussion
on Truth and Logic
Forum for Philosophical Discussion
(FPD) organized a discussion program
on 'Truth and Logic' on 7th May 2010
at KSL. The program was facilitated
by Prof. Dr. Yubaraj Sangroula and
Assoc. Prof. Prakash K.C.
Assoc. Prof. Prakash K.C highlighted
Truth and Logic as reciprocal where
truth is abstract which can only be
felt and believed. Fact itself is
truth which is not changeable but
to find out the truth, analysis of
facts should be done and it is the
brain that decides the truth. Truth
is universal but the logic is contextual,
he added. He concluded his opinion
by saying truth is not the perception
but knowledge develops through perception
and perception develops through the
materials.
Sharing his experiences Dr. Sangroula
portrayed truth with knowledge, experiment
and observation. Truth is the fact
which is backed by practical experiences,
he added. But every human being has
and should have the belief because
truth can only be found through the
belief but that belief need not be
always rights, it may be false too.
However, it is the value which creates
an opinion so without value there
cannot be an opinion. He added that
belief that is justified is the truth
and belief is the substance or content
which is justified through the method
with the support of evidence that
may be the "Objects" and
"Reasoning" where an object
is something which is discovered by
senses and reasoning means parole
knowledge. Concluding the discussion
he said, the truth provides legitimacy
to our belief.

Launching
of Computerized Monitoring and Tracking
System in Human Trafficking Cases
Kathmandu School of Law (KSL) in association
with Nepal Police launched a Pilot
Test and Computer System on Computerized
Monitoring and Tracking Human Trafficking
Cases on 20th May, 2010. KSL has been
running a program in association with
Nepal Police and funding from The
Asia Foundation (TAF) to develop software
and launch the computerized system
for tracking human trafficking cases.
Under this program, software has been
developed to record and retrieve the
cases involving human trafficking
in a user-friendly way. The case can
be searched by the name of convict,
parties to the case, and issues of
the case. Similarly, cases can be
retrieved date wise, district wise,
year wise and also police station
wise. Nepal Police and any authority
or designated personnel who have obtained
password from the police organization
can visit the website of Nepal Police
and access the homepage of the software.
Currently, human trafficking cases
till date can be accessed in the link
through the website of Nepal Police.
The official launching of this system
was conducted at KSL in participation
of senior level police officials,
NGO activists, faculty and students
of KSL. Mr. Kalyan Timalsena, AIG,
Nepal Police; Ms. Parbati Thapa, DIG,
Nepal Police; Ms. Padma Mathema, Special
Rapporteur, National Human Rights
Commission; Diana Fernandez, TAF;
Prof. Dr. Yubaraj Sangroula, among
others, were present during the program.

Campaign
to Attract Women to Join Law School
and Legal Profession
KSL organized two days Train-the-Trainer
(TOT) program for launching a 'Campaign
to Attract Women to Join Law School
and Legal Profession' on 3-4 June,
2010 at KSL. The program was conducted
with an objective to train the trainers
who will later conduct awareness campaign
targeting young female university
and college students with a special
focus on plus two and graduate students.
Prof. Dr. Yubaraj Sangroula, Assoc.
Prof. Prakash K.C., Assoc. Prof. Kumar
Ingnam and Assoc. Prof. Geeta Pathak
acted as resource persons of the program
Prof. Dr. Sangroula presented on “Pluralism”
where he emphasized on ‘restructuring
of society through pluralistic attitudes’.
Assoc. Prof. Prakash K.C presented
on “Human Right: Pre-requisite
of Democracy” and Assoc. Prof.
Kumar Ingnam presented on “Democracy
and Good Governance” while Assoc.
Prof. Geeta Pathak discussed on “Importance
of Legal Education (with special reference
to Women in Law)". The trainee
of the program will conduct awareness
campaign in various universities and
collages targeting young female students
of plus two and graduate level.
A separate training cum orientation
was conducted on 6th of June, 2010
for participants of LL.M. and LL.B.
who are selected to undertake a study
on "Training Need Analysis to
Attract Women to Join Legal Profession"
as a part of the campaign. The trainee
will conduct interview to the advocate
women, judges, government attorney,
private lawyers, and academicians
to find out the reason behind less
participation of women in legal education
and legal profession. The interview
will be conducted in three different
places of four development regions
namely Kathmandu, Nepalgunj, Biratnagar
and Pokhara.
Recognizing the vital role of law
schools, KSL in collaboration with
UNDP "Enhancing Access to Justice
Project" is conducting this program
with an intention to break the misconceptions
looming large in the legal education.
It also intends to attract more girls
and women to law education and legal
profession to enhance their access
to justice and equality.

Awareness
Campaign to Attract Women to Join
Law School and Legal Profession
KSL under Campaign to Attract Women
to Join Law School and Legal Profession
has been conducting one day awareness
campaign in different colleges of
Kathmandu, Lalitpur and Bhaktapur.
The trainee of Train-the-Trainers
program held on 3-4 June 2010 are
conducting awareness campaign in various
higher secondary schools. Total five
programs in Pinnacle Academy, Khowpa
Collage, Mahalaxmi Academy, Grand
Academy were complete. The campaign
had aimed to cover thirty higher secondary
schools including government school
of four development regions.
In the awareness campaign the trainers
provided overview on the importance
of legal education which is necessary
for restructuring the society through
pluralistic approach. The trainers
also discussed on the importance of
legal education to women. The Campaign
was supported by Supreme Court, Nepal
and UNDP under the Access to Justice
Project.

Panel
Discussion on Combating Trafficking
in Persons through Effective Prosecution
Kathmandu School of Law (KSL) marked
an anti-trafficking event through
organizing panel discussion on 'Combating
Trafficking in Persons through Effective
Prosecution' on 15th June, 2010. The
program aimed at finding ways and
approaches for the effective prosecution
of human trafficking related cases.
The program was addressed by Key-Note
Speaker Dr. Robin Haarr, Associate
Professor, Eastern Kentucky University;
Dave Sadoff, Nepal Country Director
of the American Bar Association Rule
of Law Initiative; Ms. Muna Basnyat,
Program Officer, Tdh; and Prof. Madhav
Prasad Acharya, Professor Incharge,
KSL, as panelists. Assoc. Prof. Geeta
Pathak moderated the program chaired
by Assoc. Prof. Prakash K.C., Principal
of KSL.

Research
on Baseline Survey in Nepal on Juvenile
Justice
Students of Kathmandu School of Law
(KSL) conducted an extensive field
research in all 75 districts of Nepal
under the project "Baseline Survey
in Nepal on Juvenile Justice".
The project was undertaken by Centre
for Legal Research and Resource Development,
sister organization of KSL. The project
was aimed at exploring the situation
of juvenile and juvenile reform homes,
identifying the numbers of juveniles
conflicted with laws, exploring the
practices of police, prosecutors and
court in handling cases involving
juveniles, observing the functioning
of juvenile benches whether they are
compatible with recognized standards
and finally exploring the application
and possibilities of diversion in
juvenile cases.
The research team visited 45 districts
to collect primary data and in remaining
thirty districts, data was collected
through focal persons. The data were
primarily collected from Court, District
Attorney Office, District Police Office,
Chief District Office and Prisons.
As the part of the research, students
studied the functioning of the court,
juvenile benches, police and chief
district office and so forth.
In a separate program, students of
LL.B. 1st Year conducted a field visit
at Ranikot Village Development Committee
on 9th of April, 2010. Students made
a trek from Suryabinayak to Ranikot
to observe life style of the local
residents. They also interacted with
the villagers about local education
and health facilities. The filed study
observed difficulties in making an
easy access to education where local
students are bound to make hours of
walk to reach their school every day.

Faculty
Facilitate National Conference on
ICCPR and Police Officers' Graduation
Training Course
Prof. Dr. Yubaraj Sangroula disseminated
the State Report on International
Covenant on Civil and Political Rights
at the National Conference on 26th
May, 2010. The program was organized
by Ministry of Home Affairs. In the
program Dr. Sangroula presented the
final draft of the State's Report
on ICCPR to the stakeholders including
NGOs. Dr. Sangroula presented the
glimpse of Nepal's current position
in safeguarding the civil and political
rights. The conference was aimed at
informing different stakeholders on
state's report on ICCPR. Dr. Sangroula
was assigned by Nepal Government as
a consultant to prepare the State's
Report on ICCPR that will be presented
at UN Human Rights Committee. Asst.
Prof. Kapil Aryal worked as a researcher
for the preparation of the report.

Executive
Director Visit and Facilitate Teaching
Sessions in Bangladesh
Prof. Dr. Yubaraj Sangroula, Executive
Director, KSL, visited Chittagong
University Law Faculty and Southern
University (Chittagong) Law Department
on 11th and 12th June 2010 respectively.
On that occasion, Prof. Sangroula
addressed a talk session for students
and faculties on 'South Asian Jurisprudence:
A Philosophical Discourse'. The problems
of law and justice reforms faced by
the South Asia were major crux of
his presentaion.
The Legal Education of South Asia
suffers from neglect of 'governments
and universitities', lack of research,
clinical methods and traditional practice
of indoctrination of students on common
values and principles as common problems,
he added. Students at LL.B. level
are especially confused of their future
mission. While professionalism is
emphasized focusing on traditional
values and principles of 'Court Lawyering',
the social engineering as a vision
of the legal education is never emphasized.
He pointed out that 'the students
have been put in illusion that legal
profession has nothing to do with
emergning social facts'.
Dr. Sangroula has been engaged in
teaching at South Asian Institute
of Advanced Legal and Human Rights
Studies, a new initiative of collaboration
among teachers and jurists of South
Asia with a view to promoting higher
legal education and ensuring human
rights and the rule of law in the
region. Dr. Kamal Hossian, a legal
luminary and former law and justice
and foreign minsiter of Bangladesh
is a chairperson of the Governing
Council of this institution. Prof.
Madhav Menon, Prof. V. Nagaraj (National
Law School India University, Banglore),
Dr. Yubaraj Sangroula, KSL and Dr.
Mizanur Rahman are faculties of the
Institute.
In a separate meeting with faculties
from Chittagong University and Southern
University, Prof. Sangroula discussed
on the ideas of collaboration of those
institutions with KSL.

cum Workshop with Foreign Service
Officials on Anti-Trafficking Issues
Assoc. Prof. Prakash K.C. and Asst.
Prof. Kapil Aryal conducted an Orientation
cum Workshop with Foreign Service
Officials of Nepal on the theme 'Strengthening
Victim and Witness Protection for
Successful Prosecution of Traffickers'
on 25th June 2010. The program was
conducted in Kathmandu. The orientation
was focused on the basic concept of
human trafficking with reference to
“Human Trafficking and Transportation
Control Act 2007”. The discussion
was also held on the issue of human
trafficking in relation to international
law and standards and its application
in Nepalese context. It was tried
to distinguish the differences between
human trafficking and human smuggling
through the group exercise in the
program.

in Advance Certificate Courses
Asst. Prof. Mukesh Dhungana and Teaching
Faculty Mr. Suraj Basnet, along with
two students Mr. Bishnumani Adhikari
and Mr. Udhav Prasad Bhattarai of
LL.M. participated in Advanced Certificate
Courses on Clinical Legal Education
(CLE) and Alternative Dispute Resolution
(ADR) organized by South Asian Institute
of Advanced Legal and Human Rights
Studies (SAILS) from 29th May-29th
June 2010 in Dhaka, Bangladesh. The
program was aimed to promote rule
of law and strengthen justice system
throughout the South Asian region.
Lawyers for Alternative Dispute Resolution
(ADR) and teachers for Clinical Legal
Education Program from South Asian
region including Maldives, Bhutan,
Sri Lanka, India, Bangladesh and Nepal
participated in four weeks residential
course. Dr. Mizanur Rahman, Honorary

Centre State Relations, Govt of India;
Prof Zakir Hossain, Dean, Faculty

After the successful completion of
the Course, participants from KSL,
Asst. Prof. Mukesh Dhungana was awarded
with Best Clinical Legal Education
Award while Mr. Suraj Basnet and Mr.
Bishnumani Adhikari bagged Positive
Contribution Award.

KSL's
Participation in Human Rights Education
Workshop, Copenhagen
Kapil Aryal, Asst. Prof. KSL participated
in the Human Rights Education Workshop
held from 23-25th November, 2010 in
Copenhagen, Denmark. Mr. Aryal made
a presentation on 'Kathmandu School
of law's Initiatives in Human Rights
Education'. The program was organized
by Danish Institute for Human Rights,
Danmark.
Diverse issues on Human Rights Education
were discussed at the sessions. The
discussions were concentrated on World
Program on Human Rights Education
and Developing Methods for Teaching
Human Rights. Seven participants from
China, Nepal, Morocco, Malawi, Zambia,
China and Yemen had participated in
the program.
3. MOOT COURT COMPETITION
- KSL participation in GMIC
Moot Court Competition
The team of students from KSL participated
in GMIC Moot Court Competition from
3rd-7th Feb 2010 at Gujrat India. The
competition was based on the issues
of trade law; trans-boundary environmental
harm, etc. Participants from India,
Pakistan, Hungary, USA and Nepal participated
in the competition. Team of students
comprising Anjana Adhikari (LL.B 5th
Year), Niti Karki (LL.B 5th Year) and
Swechha Ghimire (LL.B 3rd Year) represented
from Nepal.

Harish Memorial Government Law College
International Moot Court Competition
Students of KSL Ms. Swarnima Bhandari,
LL.B 4th year; Ms. Ankita KC and Ms.
Akriti Giri, LLB. 3rd year participated
in D.M. Harish Memorial Government Law
College International Moot Court Competition
held in Mumbai, India from 12-14th February,
2010. The competition was organized
by Moot Court Association of Government
Law College, Mumbai India. Total 25
teams of law students from India, Nepal,
Sri Lanka, Jamaica, Ethiopia, Mauritius
and the United Kingdom participated
in the Moot Court Competition.
The Moot Court Competition had the issues
on International Law, International
Human Rights Law and the issues of Terrorism.
The panel discussion on the inaugural
day laid emphasis on the growing trend
of global terrorism and the manners
or the ways to be taken for the elimination
of the terrorist activities.
- KSL bagged first prize in
National Moot Court Competition
Kathmandu School of Law (KSL) won first
prize in National Round Moot Court Competition
and various other extra curricular activities
organized by Nepalese Law Students Association
(NeLSA) on 14th and 15th March 2010.
Students of LL.B. Mr. Anil Kumar Shrestha,
Mr. Kriti Singh Bhandari and Ms. Anita
Jadhari stood first in the competition
by defeating the team of Nepal Law Campus.
Additionally, KSL students Ms. Srijana
Regmi and Mr. Rahul Chapagain also won
second prize on the Law Reform Competition
organized by NeLSA.
- KSL Students bagged awards
in ACE FEST
Students of KSL bagged awards in the
various categories in the program organized
by ACE Institute of Management on 14th
March 2010. The students from LL.B 1st
Year Ms. Regina Shahi, Ms. Akriti Raymajhi
and Ms. Swechhya Sangroula secured first
position, first runner up and second
runner up respectively in the title
of best manager, Collage, Calligraphy
and sketching in the competition.
Additionally, a group of students Ms.
Roshi Bhandari, Ms. Samjhana Ghimire,
Ms. Yugichhya Sangroula, Mr. Keshav
Bhattarai, Mr. Neetij Rai, Mr. Surendra
Rajaura and Mr. Sundar Bahadur Seni
also participated in in dance competition
in the same program.

Competition
A team from KSL comprising four students
of LL.B. 4th year Mr. Nischal Pokharel,
Ms. Pooja Khatri, Ms. Nishika Sharma
and Mr. Prabin Subedi participated in
51st Philip C. Jessup International
Law Moot Court Competition held from
18-27 March, 2010 in Washington DC.
The competition was organized by International
Law Students Association.
- Kathmandu School of Law participation
in Asia Cup 2010
A team of Kathmandu School of Law comprising
Ms. Rojina Thapa, LL.B 4th year, Ms.
Akriti Giri, LL.B 3rd year and Ms. Srijana
Regmi, LL.B 3rd year participated in
the International Law Moot Court Competition
"Asia Cup 2010" held from
22 - 25 August in Tokyo organized by
Ministry of Foreign Affairs, Japan.
This year the case concerned Human Rights
in relation to Environmental Protection.
Team was selected for the Oral Round
through the Qualifying Memorial Round.
Ten teams representing nine countries
viz. China, Indonesia, Japan, Malaysia,
Nepal, Philippines, Singapore, Thailand
and Vietnam participated in the competition.
Additionally, Ms. Rojina Thapa also
participated in the Symposium held from
26 - 28 August in Hakone, Japan organized
by International Law Student Exchange
Council. Nine countries Viz. China,
Indonesia, Japan, Malaysia, Nepal, Philippines,
Singapore, Thailand and Vietnam participated
in the Symposium. This year the theme
of Symposium was Global Warming, where
representative of participating countries
presented report of the Actions taken
by the respective country to tackle
the Global Warming.
- KSL qualified for regional
round of Henry Dunant Moot Court Competition
to be held in Delhi
A team comprising Mr. Nishcal Pokharel,
Mr. Anurag Devkota and Ms. Swarnima
Bhandari of KSL were selected for the
10th Henry Dunant Memorial Moot Court
Competition held in Delhi from 22 -
24 October 2010. KSL team competed with
the team from Nepal Law Campus in the
national round organized at the ICRC
on 30th September 2010.
Mr. Nischal Pokharel won the Best Advocate
award in the competition, whereas, Nepal
Law Campus received Best Researcher
award.
- KSL won Best Advocate Award
in International Moot Court Competiton
Mr. Nishcal Pokharel of LL.B 5th Year
won Best Advocate Award in 10th Henry
Dunant Memorial Moot Court Competition
held in New Delhi from 22-24 October
2010. Total five teams from India, Bangladesh,
Sri Lanka, Iran including Nepal participated
in the competition. The issue of this
year competition was forcible transfer
and deportation, wide spread and systematic
attack. Mr. Anurag Devkota and Ms. Swarnima
Bhandari was also the member of the
team who represented in the competition.
- KSL bagged Best Endeavour
Award
A team of KSL comprising Ms. Srijana
Regmi and Mr. Rahul Chapagain of LL.B
4th year won Best Endeavour Award in
5th LAWASIA International Moot Court
Comeptition held in New Delhi. The comeptition
was held from 11th -14th Nov 2010 in
association with Law Association for
Asia and the Pacific; Bar Association
of India.

SPEECH, DEBATE
AND QUIZ COMPETITION
-
Debate
and Speech Competition
KSL annually organized Intra class
debate and speech competition for
the students of LL.B 2nd year and
1st year respectively. In the competition
students are provided with an opportunity
to have discourse on contemporary
issues and deepen their knowledge
in the area of their study. The competiting
team put forward their idea on the
constitutional deadlock, federal structure
of Nepal, extension on the tenure
of UNMIN, regional cooperation for
strengthing foreign policy of Nepal
and so forth. The final two teams
from debate completion and five speakers
from speech completion will compete
in the final round of the competition
going to be held on annual day of
KSL i.e. 5th January 2011.

KSL organized welcome and farewell
program on 5th February, 2010 for
welcoming new comers in LL.B. and
LL.M. and also wishing successful
academic as well as professional career
to the pass-out students of LL.B.
5th year and LL.M. 2nd year. The program
was organized in initiation of students
of LL.B. 2nd Year.
Prof. Madhav Pd. Acharya, Professor
Incharge, chaired the program. The
program featured welcome speech, poem
recitation, cultural show and keynote
remarks from faculty and students.
The outgoing students expressed their
gratitude to KSL for providing the
cordial environment to nurture them
academically. They admired the cooperation
received from the KSL staff, faculty
and students.
Expressing his remarks on the present
political situation of the country
and youths mentality, Asst. Prof.
Narayan Sharma wished all the outgoing
students to positively tackle with
every issue in their professional
career. He also encouraged newly admitted
students to devote their time for
engaged learning. Wishing the outgoing
students and motivating the new students,
Dr. Yubaraj Sangroula urged them devotion
learning and investing time for future.
He also highlighted some of the issues
to be strictly maintained by legal
professionals. Law students who need
to work for the society after their
graduation should maintain some decorum
of their dresses, language and other
things, he added.

KSL celebrated
its 10th Annual Day amidst various
programmes
Kathmandu School of Law (KSL) marked
its tenth anniversary on 21st Poush,
2066 (5th January, 2010) amidst various
programmes. Chairperson of the National
Human Rights Commission Kedar Nath
Upadhaya, who is also the patron of
KSL, inaugurated the programme by
releasing three books authored by
KSL professors. The programme also
observed felicitation to prominent
personality, award distribution and
certification to KSL students, faculty
and employees, final round of debate
and speech competition among LL.B.
students and keynote remarks by distinguished
personalities
The programme also observed the felicitation
of Prof. Kapil Shrestha for his significant
contribution for the promotion of
democracy, human rights, rule of law
and legal education. Chairperson of
the National Human Rights Commission
Kedar Nath Upadhaya felicitated Prof.
Shrestha by providing a token of appreciation
on behalf of KSL. Addressing the gathering
after receiving the great applause
and adulation, Prof. Shrestha thanked
KSL for the honour and also highlighted
on some of the hindrances while approaching
for the Deem University.
Similarly, Sher Bahadur Karki was
awarded by cash prize and a letter
of recognition for being nominated
as the best employee of the year 2009.
Chief Guest Upadhaya also distributed
medals and certificates to KSL teachers
and students in recognition of their
academic excellence and contribution
to the promotion of School's initiatives.
Speaking on the same occasion, presidential
candidates of Nepal Bar Association
election advocates Hari Krishna Karki,
Matrika Niroula, Prem Bahadur Khadka
and Ram Nath Mainlai expressed serious
concerns over the problems grappling
the judiciary system. The programme
was also addressed by Mr. Ramesh Adhikari
from MS Nepal and Mr. Raju Chapagain
from OHCHR.
Earlier, in course of highlighting
on the major initiatives and activities
of the one year period, Executive
Director Dr. Yubaraj Sangroula accentuated
the intervention made by KSL to design
the concept on structure, powers and
functions of local governance system
in the new constitution, collaboration
with the University of Sydney to educate
the stakeholders of criminal justice
system and establishment of International
Advisory Committee. He also disclosed
the initiation of Master's Degree
Programme in Human Rights and Democratisation
in collaboration with University of
Sydney along with Mahidol University
(Thailand), Gadjah Mada University
(Indonesia) and University of Colombo
(Sri Lanka).
The formal session was followed by
cultural programme. Annual Report
of the School was also distributed
to all the participants. Students,
faculty, staff, guardians, dignitaries
from different walks of life, representatives
from government and non government
organizations, media personnel, and
members of KSL Council and Management
Committee were present at the programme.

KSL nominated
as Member of 'Free Access to Law Movement'
This year Kathmandu School of Law
(KSL) is nominated as a member of
the Free Access to Law Movement (FALM).
Australasian Legal Information Institute
(AustLII) has nominated KSL for membership
of the FALM. The nomination of KSL
for membership was warmly received
at the annual meeting of Legal Information
Institute (LII) in Durban, South Africa.
Accordingly, a database entitled 'Kathmandu
School of Law Research Series' have
been added at <http://www.asianlii.org/np/journals/KathSLRS/>,
as a start toward including KSL data
<http://www.ksl.edu.np/legal.asp>
on AsianLII. Visitors can find scholarly
output from KSL in one database, including
both the KSL Journal and the Kathmandu
Law Review. KSL will very soon upload
other materials at as well.

KSL Students
ranked Second and Third Position in
Bar Council Exam
The students of KSL Ms. Puspa Pokharel
and Ms. Jooni Khadka secured second
and third position in Bar Council
exam of 2067 B.S. Out of 476 appeared
examinee Ms. Pokharel and Ms. Khadka
scored second and third position.
Ms. Pokharel with first division also
bagged first position among the females.
This year total 21 students from KSL
appeared the Bar Council Exam.

KSL students
received awards from Cheif Justice
and President of Nepal
Puspa Pokharel was honored by two
certificates for being the second
topper amongst all the examinees and
topper amongst the girl examinees
in the examination of advocates for
the license required for the advocacy
in Nepal. The honor was provided on
the Nepal Bar Council day by the Chief
Justice of Supreme Court of Nepal
on 12 August 2010.
Binaya Sidgel who graduated from Kathmandu
School of Law in 2007 and Puspa Pokharel
who graduated in 2009 were awarded
with the Bidhya Bhushan Shreni "Ga"
and Nepal Chattra Padak respectively.
The award was handed over by the His
Excellency the President of Nepal
on behalf of Government of Nepal.
Awards were provided on "Shikchya
Diwas" on 8 August 2010. Binaya
Sigdel was awarded for being the topper
amongst the students in Purbanchal
University under law faculty and Puspa
Pokharel was awarded for being the
topper amongst the girl students in
Purbanchal University 2004 batch.

KSL organized
6th International Residential School
of Economic Social and Development
Rights
Kathmandu School of Law (KSL) organised
the 6th International Residential
School on Economic, Social and Development
Rights (ESDR) and Good Governance
with special reference to Emerging
Issues of Human Rights from 21st October
-14th November 2010.
The program was organized by KSL in
technical cooperation with South Asian
Institute of Advanced Legal and Human
Rights Studies (SAILS) and in association
with Centre for Research and Resource
Development (CeLRRd), Danish Institute
of Human Rights (DIHR) and Danida
HUGOU.
The inaugural session was held on
21st October at the Conference Hall
of KSL with Chief Guest Mr. Gauri
Pradhan, Member of National Human
Rights Commission (NHRC)–Nepal,
while the Chairperson of the inaugural
was Professor Madhav Pd. Acharya,
Professor In-Charge of KSL. Additionally,
Dr. Sangroula, Professor Zakir Hossain,
Dean, Faculty of Law, CU, Bangladesh
and Member of Bangladesh Judicial
Service Commission were also present
in the program.
Highlighting the objectives of the
residential school, the guests expressed
that no enforcement of civil and political
rights is possible and meaningful
without due respect to the economic
and social rights.
The course included thorough group
works, workshops, symposiums, country
and group presentations, panel discussions,
creative writing etc. as well as observation
visit to Armed Police Force (APF)
Head Quarter and field visit to Melamchi.
Session included diverse issues like
challenges and prospects of economic
and social rights in participating
countries, dichotomy between civil
and political rights and ESDR and
state obligations, cultural relativism,
concept of development rights, human
trafficking as a form of slavery,
impunity, social security systems
etc., among others. The resource person
included Dr. Sangroula, Executive
Director of KSL and also SAILS, Professor
Zakir Hossain, Dean Chittagong University,
, Professor Nomita Aggarwal, Campus
Law Centre, Delhi University and former
Head and Dean of faculty of Law, Delhi
University Mr. Panch Rishi Dev Sharma
from National Human Rights Commission–India,
Dr. Uttam Kumar Das, Deputy Director
of SAILS, Assoc. Prof. Geeta Pathak
Sangroula, President CeLRRd, KSL,
Assoc. Prof. Prakash K.C., Principal
KSL, Assoc. Prof. Hong Kong Rana,
Academic Incharge, KSL, Mr. Dave Sadoff,
Country Representative, ABA-ROLI,
and renowned law professors and experts
from around the world and government
high-ups from Nepal.
At the end of the program 17 participants
were awarded with whereas Ms.Huang
Xianjing from the Communication University
of China bagged the “Overall
Performance Award”. She also
jointly obtained the “Academic
Excellence Award” with Ankita
K.C. of KSL after winning the Elocution
Competition.
The training came to an end on 14th
November with a closing ceremony that
took place at the City Hall, Kathmandu.
Resource persons of this year’s
Residential School and other distinguished
guests from different NGOs and government
organizations were present there.
The Chief Guest said that this intensive
course gave a golden opportunity to
the students from different parts
of the world to get together and get
a chance to learn importance, relevance
and contemporary issues regarding
social, economic and development rights,
and also dynamic linkage with human
rights and democracy besides developing
their leadership skills.

KSL organized
South Asian Teaching Session on Humanitarian
Law
KSL in association with ICRC-Nepal
organized 17th South Asian Teaching
Session (SATS) on International Humanitarian
Law (IHL) from 24 November-1 December
2010.
The dignitaries from South Asian region
participated in the program which
was organized for the first time in
Nepal. The judge of High Court, Officials
of Security Agencies, Officers from
Law Ministry and academician of various
Universities from South Asian region
participated in the program.
The program served as the platform
to discuss on the issues of international
law, humanitarian law and human rights.
The program also scheduled for the
site visit of the Bhaktapur Durbar
Square, Bhaktapur Municipality. Assoc.
Prof. Geeta Pathak Sangroula, coordinated
the program whereas Asst. Prof. Suraj
Basnet participated the program.

The Kathmandu-Birgunj-Kolkata-Dhaka
Expedition School on International
Trade and Business Laws
KSL, operates several programs in
the field of law relating to business
and international trade with reference
to social development issues. ‘The
Kathmandu-Birgunj-Kolkata-Dhaka Expedition
School on International Trade and
Business Laws (October 26th-5thNovember)’
is one of the prominent programs initiated
by this year. The expedition visit,
which is a part of KSL academic program
aims to facilitate the students to
understand customs procedure at Nepal-India
border, functions and operations of
Calcutta-Port (India) and Chittagong-Port
(Bangladesh), learn about the power
and activities of legal and judicial
institutions, and to interact with
key persons in the related academic
area, judiciary and legal professions
in Bangladesh.
The team of 27 students who themselves
are professionals working as legal
practitioners, prosecutors or government
officials, have been studying for
an Master Degree in Law (LL.M.) with
specialization in Business and International
Trade Laws at KSL and was led by KSL’s
Associate Professor Kumar Ingnam.
The team was in Birgunj for a one-day
academic visit on 26thOctober and
was led by. The team visited to Birgunj
Custom Office, where they had field
observation and effective interaction
with Mr. Lawanya Dhakal, Chief Custom
Officer. On the same day the team
also had observation of Birgunj Dry-Port,
followed by the interaction about
the custom procedure with Mr. Narayan
Prasad Sharma, Chief Dry-Port Officer.
The team was in Calcutta for a two-day
academic visit from 28 to 29 October.
On Thursday, the team had a meeting
with Counselor General of NepaL Mr.
Suresh Man Pradhan about the trade
transit procedure. The team had a
visit to Calcutta Port, where they
had a depth orientation from Mr. Ashish
Chaudhary, Assistant Manager, Calcutta
Port Trust about the Sea Port and
Calcutta Port Procedures.
The team was in Dhaka for a two-day
academic visit from 30 to 31 October.
On Sunday, the team separately met
with Justice Nizamul Haque, Chairman
of the International Crimes Tribunal
(ICT); Professor M. Shah Alam, Chairman
of the Law Commission, and Professor
Mizanur Rahman, Chairman of the National
Human Rights Commission.
The team members attended separate
seminars and discussion programs organized
by South Asian Institute of Advance
Legal and Human Right Studies (SAILS),
which is an autonomous institute to
promote legal knowledge and respect
for human rights throughout South
Asia and law departments at Southeast
University, and Stamford University
Bangladesh. The team also visited
Chittagong Port on November 1, they
were oriented by Officer at Chittagong
Port Trust about the Chittagong Port
Procedures.
