The department was established in the
year 2004 with an objective to promote
scientific education of law and meet the
primary goal of KSL that is to achieve
excellence in research. It carries out
research as regular activity of the institution
and explores areas of research involving
the students. The department functions
by exploring the areas of need to research
and develops applicable methodology for
its conduction. The findings then are
put forth for discussions among researchers
and experts in the related field and brought
into conclusion.
It provides academic assistance to individual
student and the team to conduct any type
of research activities as a part of their
academic pursuit. During the year 2062
the department carried out number of research
activities mobilizing students in cooperation
with various national and international
organizations.
Activities
Conducted by the Department in 2005-06
The following are the major activities
conducted during this year:
1. Research on
Role and Performance of Media in Nepal
The center conducted research on Role
and Performance of Media in Nepal involving
LL.B students to find out the contribution
of media in promotion of democracy and
peace. The study covered 13 electronic
media including 6 FM Radio stations and
31 print media including 9 daily newspapers,
11 weekly, 1 fortnightly and 10 monthly
magazines in order to analyze, both quantitatively
and qualitatively.
The different materials and the coverage
in the media were examined to find whether
the printed items expressed solidarity
to promote peace and pro-democracy or
vice versa. The data revealed pessimistic
scenario in the above two issues, and
most of the vernaculars were found allocating
only small slot for the emerging two issues.
Major portion of the coverage was given
to unfolding the attitudes and behaviors
of the warring and political parties instead
of encouraging agreements. The findings
showed that the media are playing the
role of ‘highlighter’ instead
of ‘negotiator’ in the resolution
of conflict.
2.
Students Mobilization Program
Extensive discussion programs were organized
among students of different level and
of different places in order to orient
the youths on Role of Youths in Transformation
of Present Conflict. A total of 30 programs
were conducted during the year benefiting
more that 1500 students from different
schools and colleges inside and outside
of the valley. The topics covered in the
discussion were civic education, human
rights, good governance, democratic values,
politics, and conflict transformation.
KSL faculty and researchers of the center
acted as Resource Persons for the program.
The program was organized in support of
Embassy of Denmark, Kathmandu.

Research on Dispute Settling Mechanisms
in Mustang District
Students of LL.B 3rd Year in cooperation
with the center conducted field research
on Dispute Settling Mechanisms in Mustang
District with special reference to Mukhiya
System. The research traced out some distinctive
findings and came up with suggestions
to the policy makers in order to establish
effective judicial behavior of the people
in Mustang.
The study shows that the people of Mustang
have been practicing the Mukhiya system
from the very ancient epoch and are still
very faithful about the system and its
functioning. It is so effective in the
district that any intervention upon it
may create a situation to turmoil the
entire society. The local laws based on
religious belief and faiths are applied
in community, which is not in conflict
with the state laws in most of the aspects.
But the present condition is yet not satisfactory
in many terms. Thus, the study recommends
that some of the steps are necessary to
ensure the better practice of justice
in the district in future.
4.
Study on Cause of Delay Justice in Corruption
Cases
The department carried out the study to
determine the factors for the delay in
deciding cases and case backlog in the
Special Court with a view to improving
the Special Court and strengthening its
management capacity. The preliminary data
shows the formal and lengthy procedure
prescribed by laws, and lack of proper
cooperation among concerned institutions,
offices and individuals being the primary
setbacks for the delay rather than investigation
process. Other identified causes include
ignoring summons by alleged offender and
lack of proper information about alleged
offender’s contact etc.
5.
Research on Situation of Domestic Violence
on Women in Kavre District
The department helped LL.B 2nd year students
to carry out research on situation of
domestic violence on women in Kavre District,
which interestingly found out that there
is low rate of such violence in this community
in comparison to other ethnic communities
like Brahmin and Chettris. The research
covered 25 households in Naldum and Dhadgaun
VDCs.
The study explored several positive characteristics
of life styles of that community which
can be learned by other. The community
were well conscious about providing education
to both the son and the daughter though
there was less percentage of daughter
getting higher education; they were not
only conscious of educating youngster
but also to the old generation for which
informal education was conducted; they
hold a good understanding between the
family (husband and wife) so the existence
of patriarchy society is almost nil.
Moreover, women were engage in social
work, which was the good indicator of
women empowerment, though many were only
of short term. They are conscious about
the health and sanitation of mother during
pregnancy; interestingly, they have not
yet accused anyone of being witch, which
lately has become an awful fate for rural
women on the basis of some constricted
perceptions. And the villagers don’t
rigidly press their daughter in laws for
nuisance dowry. By these indicators, the
study shows there is less chance of domestic
violence in this community.
6. Research Assistance
to LL.B and LL.M Programs
Apart from conducting independent study,
the department provided assistance in
research activities conducted by the centers
affiliated with the LL.M Program as well
as LL.B Program. In the 16 days activism
against violence against women, it assisted
students to develop questionnaire, research
modules etc. Similarly, in the 2nd Winter
Residential School on Socio Economic and
Good Governance, the center provided its
expertise to orient students on methodology
to conduct field study and to develop
survey questionnaire.
7.
Five Days Residential Seminar on Legal
Research
The department organized a five days residential
seminar on Legal Research in coordination
with three centers of the LL.M program
for the newly admitted LL.M students.
The seminar helped students to enhance
their knowledge about scientific writing,
science and commonsense, specific components
of research and its methodologies and
the critical logical thinking. All newly
admitted students in LL.M program participated
in the program before the formal commencement
of their class.
